WAIVER - In consideration of the foregoing, I, for myself, my heirs, executors, administrators, personal representatives, successors and assigns, waive and release any and all rights, claims and courses of action I have or may have against The Horse Thief 30m/20m/10m/5m Trail Run, TrailZen, Event Data Solutions, Inc, Joe & Joyce Prusaitis, Horse Thief Hollow Ranches, LTD., and Joseph G Wheeler and his property at 7901 Spicewood Springs Rd 78759, their agents, employees, officers, directors, successors and assigns, and any and all sponsors, their representatives and successors, that may arise as a result of my participation in The Horse Thief Trail Run (30m/20m/10m/5m) and any pre- and post- event activities. I understand that this event may cause serious bodily harm including broken bones and even death. I attest and verify that I am physically fit and have sufficiently trained for the completion of this event and my physical condition has been verified by a licensed medical doctor. I also understand that this is a USA Track and Field Sanctioned event and all USATF rules and regulations govern this event. Further, I hereby grant full permission to any and all of the foregoing to use any photographs, motion pictures, recordings, or any other record of this event for any legitimate purpose including commercial advertising.

In consideration of crossing, leasing, participating in programs, organized trail runs using or otherwise being present in, on or upon the private property, including my traveling to and from the property of Horse Thief Hollow Ranches, LTD., located at 7815 Spicewood Springs Rd. Austin, TX. 78759; also known as Horse Thief Hollow, and Joseph G Wheeler property located at 7901 Spicewood Springs Rd 78759. I, for myself and my estate, heirs, administrators, executors, and assigns, hereby release, forever discharge and hold harmless Horse Thief Hollow Ranches, LTD, inclusive of DC Adventures, Joseph G Wheeler, TrailZen, Joseph and Joyce Prusaitis and their heirs, employees, representatives, agents, care-takers and volunteers (collectively called, the “RELEASEES”) from any and all liability and responsibility whatsoever, however caused, for any and all damages, claims, demands, or causes of action that I, my estate, heirs, administrators, executors, or assigns may have for any loss, illness, personal injury, death, property damage or theft arising out of, connected with, or in any manner pertaining to my presence in, on, upon property, improvements, equipment, land, or my traveling to and from the property of Horse Thief Hollow, and/or Joseph G Wheeler property, including programs provided by 3rd parties, whether caused by negligence of the RELEASEES, accident, omissions or otherwise. I fully understand that there are potential risks associated with Horse Thief Hollow, a natural area that include but are not limited to; bodies of water, falling/fallen timber, rocks, ruts and holes, equipment, animal traps, safety hazards, and wild animals including venomous snakes. Insects that include but are not limited to; Brown Recluse Spiders, Black Widow Spiders, Yellow Jackets/Bees; and Mosquitoes known to spread WEST NILE VIRUS and Ticks. Further hazards include but are not limited to risks potentially caused by; terrain, facilities, temperature, weather, weapons or ammunition of any kind, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, employees, family members, caretakers, hunters, hikers, campers, residents, neighbors, and/or producers of any activity. My presence is voluntary to be in, on, or upon the property of Horse Thief Hollow and Joseph G Wheeler property and I voluntarily assume all risks and responsibility for loss, property damage, illness, and personal injury, including death whether caused by negligence of the RELEASEES, accident, omissions or otherwise. I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during any activity. I understand while I am in, on, or upon the property, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any and all purposes. I further hereby agree to indemnify and hold harmless the RELEASEES from any loss, liability, damage, judgment, settlement, or costs, including court costs and attorney fees, or medical fees that they may incur due to my presence or participation in, on or upon the property of Horse Thief Hollow, Joseph G Wheeler property including programs provided by 3rd parties, whether caused by negligence of the RELEASEES, accident, omissions or otherwise. In signing this agreement, I acknowledge and represent that I have read and understand it; that I sign it voluntarily; no oral representations, statements, or inducements have been made. I am at least eighteen (18) years of age and fully competent. This agreement shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

 I understand that I am giving up substantial rights by signing it, and voluntarily agree to be bound by it.
